Terms of Service

By creating an account or using elev8ads.io, you agree to these terms. If you don't agree, don't use the service.
1. The service
elev8ads provides AI-powered competitor ad research, script generation, UGC video creation, and Meta Ads launch workflow. We're a tool — you remain responsible for the ads you publish and the claims they make.
2. Your account
- You must be 18+ and able to enter binding contracts.
- You're responsible for keeping login credentials secure.
- One account per person/entity unless we agree otherwise in writing.
- You connect your own Meta ad account; we never launch ads in active state.
3. Acceptable use
You agree NOT to use elev8ads to:
- Generate ads for illegal products, scams, or content prohibited by Meta's ad policies.
- Impersonate real people without consent.
- Scrape or reverse-engineer the platform.
- Resell access without an Agency plan / reseller agreement.
- Bypass plan limits or credit metering.
4. AI-generated content
elev8ads generates content using third-party AI providers (Anthropic Claude, HiggsField). You own the outputs you generate, subject to the providers' underlying terms. We don't guarantee originality, factual accuracy, or absence of similarity to existing works. Review every output before publishing.
5. Plans, billing, credits
- Subscriptions billed monthly via Lemon Squeezy (Merchant of Record). Taxes handled by Lemon Squeezy.
- Plan video credits reset every 30 days from your billing anchor; unused plan credits don't roll over.
- Credit packs purchased separately don't expire.
- Cancellation effective at the end of the current billing period — no proration. Plan downgrades take effect next cycle.
- If a video generation fails server-side, credits are automatically refunded.
6. Refunds
14-day refund window for the first paid month if you haven't used video credits or launched campaigns. Email hello@elev8ads.io. No refunds after 14 days or once usage thresholds are crossed.
7. Service availability
We aim for high uptime but don't offer a formal SLA on Free/Starter/Pro. Agency customers may negotiate SLA terms. We're not liable for downstream provider outages (Meta, Anthropic, HiggsField).
8. Intellectual property
The elev8ads platform, code, prompts, and brand are ours. The campaigns, scripts, and videos YOU generate are yours, subject to the providers' license terms.
9. Liability
To the maximum extent permitted by law, our liability is limited to fees paid in the 12 months preceding the claim. We're not liable for indirect, incidental, or consequential damages. We're not responsible for ad spend losses, Meta account bans, or downstream business impact.
10. Termination
You can cancel anytime via the billing page. We can terminate accounts for breach of these terms or non-payment after reasonable notice. On termination, your data is deleted within 30 days.
11. Changes
We may update these terms. Material changes will be emailed to active users at least 14 days before taking effect. Continued use after changes = acceptance.
12. Governing law
Dutch law applies. Disputes go to the courts of Arnhem-Leeuwarden, Netherlands.
